New EEOC Rules on Criminal Background Screening for Job ...

Criminal background checks can make the workplace safer and prevent lawsuits against the employer for negligently hiring or supervising an employee with a criminal history of violence, abuse, fraud, theft, or drug / alcohol abuse if that employee later harms someone else while on the job. However, new EEOC guidelines have placed stricter limits on when and how employers can use these criminal background checks to screen out unsuitable job applicants.????

The EEOC ? Equal Employment Opportunity Commission ? conducts investigations and brings lawsuits to enforce federal laws that forbid employment discrimination based on race or national origin. The EEOC has issued new guidelines that specifically state that the EEOC considers employers? use of criminal background checks to screen applicants to have an adverse impact on black and Latino applicants, and therefore to be potentially discriminatory. ?The new EEOC guidelines provide that employers who conduct criminal background screenings can be required to prove that the screenings are both 1) specifically job-related and 2) consistent with business necessity. The EEOC reaffirms its previous guidelines that the screening decision should take into account:

  1. The seriousness of the offense or conduct;
  2. The time that has passed since the offense; and
  3. How the offense relates to the job position.

New this year, the EEOC has added a guideline requiring that the employer also conduct an ?individualized assessment? when doing a criminal background screening. ?This requires the employer to tell an applicant when he or she is being rejected because of a criminal conviction, and to give the applicant an opportunity to show the screening was inaccurate, or to explain facts showing the conviction should not bar employment, or to provide information about rehabilitation, a successful employment history before or after the offense, or any other information useful to prove the applicant?s suitability for employment despite the conviction.?

Alarmingly, the guidelines say that an employer cannot rely on state or local legal requirements to defend against a claim that the employment screenings violate federal civil rights law by having a disproportionately large impact in excluding minority applicants.? This potential conflict makes it crucial for the employer to have a written job screening policy and record-keeping system, preferably vetted by an experienced business lawyer, to ensure the employer is satisfying both state and local requirements for criminal background checks (for example, for child care providers) and the EEOC guidelines.

California law has added its own elaborate restrictions on criminal background screenings, which must be followed along with the EEOC guidelines.? A California ?employer cannot generally ask for or use information concerning:

  • Convictions more than seven years old;
  • Convictions that were pardoned, or where the records were expunged and sealed;
  • Arrests without conviction, except where the case is pending, or except for certain arrest records where the employment is in a health care facility and the employee would have access to patients or medications;
  • Misdemeanor convictions where probation was successfully completed or discharged, and the case was judicially dismissed;
  • Convictions more than two years ago for possession or use of small amounts of marijuana, as defined by the California Health and Safety laws;
  • Participation in diversion programs to avoid prosecution or conviction; or
  • Listing on a sex offender registry, except to protect vulnerable individuals.

Both thefederal Fair Credit Reporting Act (FCRA) and the California Investigative Consumer Reporting Agencies Act (ICRA) place strict requirements on how and when applicants must be notified that their criminal background information is being sought, and further require the checks to be both accurate and confidential.

All are good photo opportunities ? whether with a "real" camera or a cellphone.?

How do I make sure photos are in focus?

Often, something is in focus, but not the thing you wanted. Many modern point-and-shoot cameras and some cellphones have a face-detection mode that you can select to recognize multiple faces and optimize the focus (as well as exposure and color) for them.

If you don't have this mode, or you want to focus on something else, adjust the focus point to be more precise.?

Newer iPhones make this easy: Simply point on the screen to the part you want to be sharp.?

On other cameras, you can often change the default ? which makes a compromise so that everything is sort of sharp ? and instead chose a smaller focus point or area.?

To do this, you may have to take the camera out of auto mode and chose program mode, typically labeled "P" on the selector. [Expect to See Photo-Sharing in Ever-More Apps]

They still look blurry. What gives?

You may still get a blurry picture if you are in low light because the camera has to keep the shutter open for a relatively long time.?

The trick here is to minimize movement. If you are buying a new point-and-shoot, get one with optical image stabilizations (OIS), which moves either the lens or the image sensor to compensate for jitters.


With or without OIS, try holding the camera steadier. Make sure you have firm footing, and keep your arms close to your body when you shoot. If you can, hold the camera against something such as a pole or a tabletop. [What Makes a High-Quality Camera?]

Space station grabs 'Dragon by the tail'

For the first time in history, a commercial spaceship has journeyed to the International Space Station, carrying vital supplies to the astronauts. NBC's Tom Costello reports.

The International Space Station's crew reached out today with a robotic arm to grab SpaceX's Dragon cargo capsule and brought it in for the orbital outpost's first-ever hookup with a commercial spaceship.

It marks the station's first linkup with a U.S.-made spacecraft since last year's retirement of NASA's space shuttle fleet, and potentially opens the way for dozens of commercial cargo shipments. If the long-range plan unfolds as NASA hopes, U.S. astronauts could be shuttled back and forth on the Dragon or similar spacecraft within just a few years.

"Today, this really is the beginning of a new era in commercial spaceflight," said Alan Lindenmoyer, manager of NASA's commercial crew and cargo program.?

The hookup comes after Tuesday's successful launch of the Dragon atop a Falcon 9 rocket, and represents the culmination of years of planning and hundreds of millions of dollars of spending by NASA and California-based?SpaceX, known more formally as Space Exploration Technologies Corp. The company was founded a decade ago by dot-com billionaire Elon Musk, with aspirations of eventually sending humans to settle on Mars.


Musk said the technologies that were tested today will blaze a trail for those more ambitious trips to come. "This is a crucial step, and having achieved this step, it?makes the things in the future and the ultimate path toward humanity becoming a multiplanet species much, much more likely," he told reporters after the hookup. "The chances of that happening just went up dramatically, so people should be really excited about that."

But first things first: Today's operation marked the first full in-space test of the robotic Dragon spacecraft's procedure for approaching the station, and for that reason, every step along the way was carefully planned out and checked over the course of several hours.?The first steps in the procedure were tested on Thursday, during a series of maneuvers that successfully brought the 14-foot-long, 12-foot-wide, gumdrop-shaped capsule within 2.5 kilometers (1.5 miles) of the $100 billion space station.

Today, a far more ambitious set of maneuvers brought the Dragon all the way to the station ? but the trip wasn't always easy.

Fixing the glitches
The craft started out by taking up a position 250 meters (820 feet) below the station. From that vantage point, the Dragon was put through a series of maneuvers to test the station-to-spacecraft communication system. The space station's astronauts had the Dragon approach, then retreat, then approach, then hold its position.

After assessing the data, NASA said it wanted to do a double-check on the Dragon's thermal imagers, which are part of the rendezvous sensor system. The spacecraft was commanded to approach to a distance of 200 meters (656 feet), then stop while NASA took stock again. Space agency spokesman Josh Byerly said SpaceX's team made "minor modifications" to the thermal imaging system, just to make sure that it was providing tracking data in line with what other instruments were showing.

The Dragon was on its way to a 30-meter (98-foot) checkpoint when the team at SpaceX's Mission Control in Hawthorne, Calif., ordered the spacecraft to retreat to a distance of 70 meters (230 feet). NASA's Mission Control said the SpaceX team wanted to correct bad laser sensor readings that the Dragon was getting from a stray reflector on the station's Japanese-built Kibo laboratory.?To work around the problem, SpaceX narrowed the field of view for the laser sensor so that it wouldn't pick up light from the offending reflector.

"One of the lasers wasn't working well, so we had to recalibrate the laser and tighten the beam, and then it did work," Musk explained afterward.

Catching a Dragon by the tail
Once the fix was made, Dragon returned to the 30-meter checkpoint and moved in for the final approach.?When the craft reached a distance of 10 meters (33 feet), NASA astronaut Don Pettit used the station's 17-meter-long (60-foot-long) robotic arm to grab hold of the Dragon's grapple attachment at 9:56 a.m. ET.

"It looks like we've got us a Dragon by the tail," Pettit told NASA's Mission Control.

"?Congratulations on a wonderful capture," Mission Control's Megan Behnken replied. "?You've made a lot of folks happy down here, over in Hawthorne and right here in Houston."?

Pettit joked that the operation went so smoothly it felt like a computer simulation.?"This sim went really well," he said. "We're ready to turn it around and do it for real."?

It took another couple of hours to pull in the Dragon and get it fully hooked up to the station's Harmony module. NASA and SpaceX refer to this operation as a "berthing" rather than a "docking," because the Dragon is being passively pulled in rather than powering itself into the docking port.

The completion of berthing at 12:02 p.m. ET put SpaceX in the company of four governmental space ventures?? NASA, the Russian Federal Space Agency, the European Space Agency and the Japan Aerospace Exploration Agency ? that have built vehicles capable of hooking up with the space station.

Musk said that he'd probably have to relax SpaceX's rule against drinking alcohol at its Hawthorne headquarters to accommodate a champagne celebration, but it was clear that the hundreds of employees who gathered to watch the berthing were already on a natural high. They cheered for Musk as he spoke to reporters over a video link???and when he told them, "I love you guys, too," they broke into a chant of "E-lon, E-lon, E-lon!"?

Unloading the cargo
Dragon's hatch is scheduled to be opened early Saturday morning. The station's six astronauts will unload about 1,000 pounds (460 kilograms) of cargo, including food, clothes, batteries and a laptop, plus 15 student-designed experiments. Then about 1,455 pounds (660 kilograms) of Earth-bound cargo?? including personal items from the crew as well as completed experiments and old equipment?? will be loaded up on the Dragon. These payloads don't come anywhere close to the Dragon's capacity (6 tons going up, 3 tons coming down), but they were made part of the mission as non-essential ride-alongs.

On May 31, the capsule will be detached from the station and sent back down toward a Pacific Ocean splashdown and recovery off the coast of Southern California. That part of the operation went off successfully during Dragon's first orbital test mission in December 2010, but this would mark the first-ever return of a commercial spacecraft from the space station. Russia's Soyuz capsule is the only other existing space vehicle capable of returning space station payloads.

A fully successful mission would open the way for commercial space station resupply missions to begin in earnest. SpaceX already has a $1.6 billion contract with NASA for 12 Dragon shipments through 2016. If all goes well, the first flight covered by that contract could lift off in September, said Mike Suffredini, NASA's space station program manager. Another company, Virginia-based Orbital Sciences Corp., is developing a cargo spacecraft known as Cygnus to take on space station shipments as well, under the terms of a $1.9 billion contract. The Cygnus has yet to be flight-tested, however.

In addition to the cargo contract, SpaceX is one of four companies that is receiving millions of dollars from NASA to produce spaceships capable of carrying astronauts. In SpaceX's case, the Dragon would be modified with a launch escape system, while the other companies ? Blue Origin, the Boeing Co. and Sierra Nevada Corp.?? are working on other spaceship concepts, ranging from capsules to Sierra Nevada's mini-space plane. The first astronaut flights could take place as early as 2017.

Until that time, NASA will have to depend on the Russians to transport U.S. astronauts on Soyuz spacecraft, at a cost of more than $60 million a seat. SpaceX and other players in the commercial space race say they can meet or beat that price.

The transition to commercial operations for orbital transport is a key part of the Obama administration's plan for future space exploration.

"We?re handing off to the private sector our transportation to the International Space Station so that NASA can focus on what we do best ? exploring even deeper into our solar system, with missions to an asteroid and Mars on the horizon," NASA Administrator Charles Bolden said after the Dragon's launch. "We?re committed to ending the outsourcing of work on America?s space program and bringing these jobs back to the United States."?

?We are going from real experiments. Look at the dudes video's there just posted.. But along with the real work comes the how does this work without our input.... It takes a good strong understanding of what we can measure. But there are always gonna be the unknowns or not explained yet. Including the uncanny scales and how they look similar but yet vast distances are measured. It's a pattern. It's life and we can control it. Getting control of the machine is the first angle of attack. That control we collectively have access to is called Us. We allow them to dictate what is right and what is wrong even if the facts show otherwise.
?This is the time of awakening. We are opening our eyes and everyday we are astonished at what we can see and is also available online. From reasonable sources.
?Listen do you actually think that the visible world is all thats exists? Our eyes and senses see very little of the available spectrum of totally available spectrum.

?All of these people who have near death experiences tell of as white light or tunnel vision with white. Well what does a baby see when it emerges from his mother? We are baby gods growing into sentient beings. Hopefully with wisdom and compassion as a major trait.

?Well in my regards that thing is only a sink of potential. The sparks are going from outer to inner as you can see from the intensity of the streamers. They flow inwards after the electrical field forms around it. Like in nature when you give water a soft base it tends to form condensations between flows and rivers will swell in certain areas and bulge in others but they tend to concentrate as they continue. This is the same process. So the electric field gets biased on and allows the free energy to flow inward twords the source potential. This is the ultimate Vacuum. A static potential Vacuum. And it is lined based. As seen in the picture from the previous post.

Ive seen some out there that use the center HV output connected to another spark coil, of the same brand and model, and they get good output from the + and - of the second coil. I wonder if you did this if you could rectify the output of the second coil to charge the battery.? ;]

In California?s Inland Empire metropolitan area, the rate was more than triple that. Using RealtyTrac?s foreclosure rates and home price data from Fiserv Case-Shiller, 24/7 Wall St. reviewed the?10 metropolitan areas with the highest foreclosure rates.

The continuing high rates of foreclosures in some areas is a disturbing trend, said RealtyTrac?s vice president, Daren Blomquist. Although the national foreclosure rate appears to have peaked, the massive number of remaining properties yet to be foreclosed may continue to hurt the U.S. market in the long term, he added. The large number of new foreclosures ?means that distressed property sales will continue to represent a large portion of overall sales for at least the remainder of this year, which in turn will keep a lid on any robust home price recovery,? Blomquist said.

After reviewing the markets with the highest foreclosure rates, it is clear that regions with the most foreclosures to date are the ones worst affected by the housing crisis. Seven of the?10 metro areas on this list had among the top?10 largest declines in home value from their pre-recession peaks. In six of the?10 regions, houses lost more than half their value in less than six years. In Las Vegas, home prices plummeted 61.8 percent between the beginning of 2006 and the end of last year.

While all?10 metropolitan areas on this list have a high foreclosure rate compared to the national average, in some cities foreclosures have begun to decline, while in others they continue to increase. For example,?of these regions with the highest foreclosure rates, the number of new foreclosures fell by 44 percent in Phoenix and by 66 percent in Las Vegas in one year. Meanwhile, foreclosures rose 38 percent in Miami and 59 percent in Tampa.

According to Kolko, while the overall decline in home prices is the major underlying force behind these areas? high foreclosure rates, it is the legal systems of the regions? respective states that?are affecting whether foreclosures are still rising or declining. Florida has a long foreclosure process, which involves the courts on many occasions, while Nevada?s process is much shorter and non-judicial. Florida is therefore far behind in liquidating its foreclosure inventory, while Nevada is far along the process.

24/7 Wall St. examined RealtyTrac?s latest foreclosure figures of new homes for April 2012, as well as the changes in the number of new foreclosures from a month prior and a year prior. In addition, we reviewed historical, current and projected home price changes, provided by Fiserv-Case Shiller.

Median home prices in the Orlando area fell by 54.2 percent from their peak in the second quarter of 2006 through the end of 2011. Of the 50 most populous metro regions in the U.S., the Orlando-Kissimmee area has the 10th-highest foreclosure rate in April of one in every 347 homes. Orlando had 2,717 new homes in foreclosure this past April, up 12.9 percent from the 2,406 in April 2011. The forecast for the future is similarly bleak. Fiserv projects Orlando homes?will continue to lose value between the fourth quarter of this year and the fourth quarter of 2013, predicting a 1 percent decline in prices over that time period.

9. Chicago-Naperville-Joliet, Ill.-Ind.-Wis.

From their peak in early 2007, home prices in Chicago fell 36.8 percent through the end of 2011. In April, the Chicago-Naperville-Joliet metro area had the largest number of new homes in foreclosure among the 50 largest MSAs, at 11,840. This represented an increase of 25.5 percent from April 2011 when 9,433 homes entered foreclosure. However, the number of foreclosures represents a 7.63 percent decline from March, when the Chicago area also led all metropolitan areas with 12,818 foreclosures. Another positive sign for Chicagoans: Home prices are projected to rise 6.3 percent annually through 2016, according to Fiserv.

8. Tampa-St. Petersburg-Clearwater, Fla.

Residents of the Tampa, Fla., metro area watched the median home price in the region fall to $137,000 in the fourth quarter of 2011 ? a 48 percent drop from its peak. The region recorded 4,295 foreclosures in April 2012. To make matters worse, that number is up from the April 2011 figure. Last April, only 2,701 new area homes were in foreclosure, meaning that foreclosures increased by 59 percent the past year. One in every 315 homes in this MSA had a foreclosure start this past April.

7. Phoenix-Mesa-Scottsdale, Ariz.

Home prices in the Phoenix region ? the country?s twelfth-largest metropolitan area by housing units ? declined by 56 percent from their 2006 peaks through the end of 2011. Although this accounted for the third-largest decline in home prices among all metropolitan areas, the Phoenix region posted a 22.64 percent decline in foreclosures from March, as the number of new foreclosed homes fell from 7,439 to 5,755. Likewise, in the last year, the number of foreclosure starts in the area fell by 44.44 percent, from 10,358 in April 2011 to 5,755 this past April.

6. Salt Lake City, Utah

Home prices in the Salt Lake City area declined by roughly 20 percent from their peak in 2007 to the fourth quarter in 2011, which is a modest decline compared to other regions on this list. Nevertheless, foreclosure rates were higher than all but five of the largest metros in the country. Compared to the 1,406 foreclosures in April 2011, April 2012?s foreclosures declined by 5.7 percent. This metro area is one of the few on the list that analysts are bullish about; home prices are projected to increase by 9.5 percent from this year?s fourth quarter to the fourth quarter in 2013.

5. Atlanta-Sandy Springs-Marietta, Ga.

As of the fourth quarter of 2011, home values in Atlanta fell by 35 percent from their peak. The Atlanta area has the ninth?highest number of?housing units of any region on the list, at 2,165,495, and the median price of these homes was just $110,000 in the fourth quarter of 2011. To make matters worse, the area?s April 2012 foreclosure figure was a staggering 7,271 homes ? the fourth most among the nation?s largest cities. Things may be on the upswing though?as the number of homes in foreclosure fell by 11 percent from the prior month.

4. Sacramento-Arden-Arcade-Roseville, Calif.

The first California?metro area?on this list, the Sacramento-Arden-Arcade Roseville area, had one in 277 homes in foreclosure in April. With home prices down 54.7 percent from their high at the end of 2005, the Sacramento area registered the fifth-largest decline in home prices. The area had the 12th-most foreclosures in the U.S. However, foreclosures are down by 39.01 percent from last year, when April 2011 had 5,160 homes in foreclosure. Additionally, the number of foreclosures also decreased by 26.7 percent from the previous month, from 4,294 to 3,147. Fiserv expects home prices in the area to rise 6.3 percent annually through the fourth quarter of ?2016.

3. Miami-Ft. Lauderdale-Pompano Beach, Fla.

The Miami metro region topped all ?Florida regions in the number of new foreclosures. It also ranks third in new foreclosure rates among the 50 largest metros with 9,031 foreclosures in April, 2012 ? a rate of one in 273. While foreclosures in the area decreased between March 2012, and April 2012, to the tune of 9.2 percent, the future appears gloomy. Prices in this region are forecast to fall another 3.8 percent between the fourth quarters of 2012 and 2013.

Although new foreclosures in the Las Vegas-Paradise region declined by 66.1 percent to 3,378 over the past year, the number of foreclosures in April represents a slight increase over March, when 3,301 new homes were in foreclosure. Making matters worse, prices are expected to fall by another 3.3 percent between the fourth quarter of 2012 and the fourth quarter 2013, according to Fiserv.

While the number of homes (1.5 million) ranks 14th of the 50 largest regions, the area?s new foreclosure count for April 2012, reached 7,049 ? fifth highest overall. It appears, however, that the situation is improving; between March 2012 and April 2012, foreclosures dropped 10.8 percent.
